What are blood alcohol levels?

What is the definition of one drink

One drink can vary depending on many factors. For example, one standard drink will depend on the type of alcohol and the alcohol content. 

For example, these are all the same when it comes to standard drinks

  • 12 oz can of beer

  • 5 oz glass of wine

  • 1.5 oz of distilled spirits

When you examine the amounts mentioned above, essentially each of these are equivalent to one drink due to their alcohol content. It takes much less volume of distilled spirit to count as a single drink due to the elevated alcohol content. Depending on what you’re drinking, “just one more drink,” can be enough to increase your BAC to an illegal level.

Variables that affect your BAC

Gender: Females tend to have a higher blood alcohol content than men. Even if you are the same weight, and height, and drink the same amount - the female will have a higher BAC. This is due to the alcohol dispersed in body-water, and women have less water content than men. Women also have less of the enzyme in their body which breaks alcohol down than man. 

Weight: The more you weigh, the more water is in your body. The water dilutes the alcohol, which causes a lower BAC level. 

Age: This is another important factor. The older you get, the greater the impact alcohol has on your body. 

Rate of consumption: The faster you drink, the faster your BAC goes up, this is straightforward.

Food: If you drink on an empty stomach, it’ll result in your BAC going higher than if you drink while, or after, eating.

What is the BAC limit in each state?

In all 50 states, .08% is the legal BAC limit. Most states have a zero tolerance level for underage drinking of .02% but New Jersey has a .01% limit. Other states like Alabama, Arizona, DC, Illinois, Maine, Minnesota, NC, and Oregon, have a zero tolerance level of .02%. Aggravated DUI, is a charge imposed when your BAC is higher than .08%. 

Types of tests used to understand your blood alcohol concentration

Field tests: If you’re pulled over due to a suspicion of dui/dwi, the officer can request you do physical tests to determine whether you’re impaired or not. This can mean touching your finger to the tip of your nose, walking in a straight line, etc. If you’re impaired by alcohol, you will probably have difficulty performing these activities.

Breathalyzer: These are portable tools used by law-enforcement when a DUI is suspected. Some breathalyzers can be problematic, if it runs on fuel cell sensors though it’s considered accurate for prosecution purposes. The breathalyzer is measuring the amount of alcohol in your breath. Individuals can purchase these tools too. 

Blood test: You have to give permission for a blood test to be done. You are in your rights to refuse a blood test to determine your BAC level. If you refuse, you could face stiff penalties like your license suspended, jail time, and fees. It’s typical for a blood test to be more accurate than a urine or breathalyzer test. 

Urine test: This is another method to measure your BAC. These are considered less accurate than blood tests/field sobriety tests. They are invasive and can’t be done via a traffic stop. Another issue is that alcohol can take up to 2 hours to show in urine, and remains in the system for up to 24 hours. It’s hard to determine if the BAC was above the legal limit at the time of the stop.
